IN THE CIRCUIT COURT OF FLORIDA, SEVENTH JUDICIAL CIRCUIT IN AND FOR FLAGLER, PUTNAM, ST. JOHNS AND VOLUSIA COUNTIES

Re: Civil Traffic Infraction Hearing Officer Program

Ref: T-2022-004-SC

         WHEREAS, the use of Civil Traffic Infraction Hearing Officers is authorized pursuant to § 318.30, Florida Statutes, and Rule 6.630 (a), Florida Rules of Traffic Court, and

         WHEREAS, pursuant to § 318.31, Florida Statutes, and Rule 6.630 (b), Florida Rules of Traffic Court, the  County Court judges and the Chief Judge of the Seventh Judicial Circuit have elected to continue the Civil Traffic Infraction Hearing Officer program in Flagler, Putnam, St. Johns & Volusia counties, and

         NOW, THEREFORE, I, JAMES R. CLAYTON, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order as follows:

  1. The jurisdiction of duly appointed Civil Traffic Infraction Hearing Officers shall be consistent with §§ 318.32 (1) and 318.325, Florida Statutes, and Rule 6.630 (d), Florida Rules of Traffic Court.
  1. County Court judges may exercise concurrent jurisdiction with a Civil Traffic Infraction Hearing Officer pursuant to § 318.32 (2), Florida Statutes and Rule 6.630 (m), Florida Rules of Traffic Court.
  1. Upon written request of the defendant, within 30 days of issuance of the citation, a case shall be assigned to a County Court judge pursuant to § 318.32 (3), Florida Statues and Rule 6.630 (n), Florida Rules of Traffic Court.
  1. The County Court judges shall instruct the Clerks of Court regarding the proper assignment of cases to ensure compliance with § 318.32, Florida Statutes, and Rule 6.630 (d), (m), (n), Florida Rules of Traffic Court.
