Re: USE OF ARTIFICIAL INTELLIGENCE (AI) BY FILERS OF COURT DOCUMENTS

            WHEREAS, the efficient administration of justice and the integrity of court documents and proceedings are of great importance, and

            WHEREAS, those who file court documents must be aware that AI-generated information may be incorrect and must therefore take steps to verify the accuracy of all information contained in filings;

            NOW THEREFORE, I, LEAH R. CASE, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order as follows:

    1. Any attorney or self-represented litigant who utilizes generative artificial intelligence (AI) in the preparation of a filing with the court must disclose its use on the face of the document and certify that they have personally reviewed it and verified its accuracy. The certification must state the following:
        • The undersigned hereby certifies that artificial intelligence was used to prepare this [TITLE OF DOCUMENT BEING FILED]. I have independently verified the accuracy of citations to the law or record, and of any language, quotations, citations, paraphrased assertions, and legal analysis drafted by artificial intelligence.
    1. If the presiding judge determines that a filing prepared in whole or in part using generative artificial intelligence fails to contain the aforementioned certification, or that it contains errors, falsehoods, or other misrepresentations as a result of the use of generative artificial intelligence, he/she may impose sanctions which may include striking the filing, denial of the requested relief, monetary penalties, or other sanctions deemed appropriate.
