IN THE CIRCUIT COURT OF FLORIDA, SEVENTH JUDICIAL CIRCUIT IN AND FOR VOLUSIA COUNTY

Re: ASSIGNMENT OF CASES IN VOLUSIA COUNTY COURT

Ref: G-2026-026-VL (A) (Rescinds G-2026-026-VL)

            WHEREAS, the prompt and expeditious administration of justice in Volusia County necessitates the publication of a revised case assignment order for the various divisions of the Volusia County Court;

            NOW THEREFORE, I, LEAH R. CASE, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order that County Court cases be assigned among the judges within civil or criminal divisions as further stated herein.

 

  1. All civil and criminal case filings are to be assigned to the designated divisions listed herein on an automatic basis in the manner described below.
  2. Volusia County Clerk of Court’s office is hereby directed to reflect the following substantive division assignments in its case assignment system effective July 13, 2026.

  1. Except for Evictions and Replevins, County Civil cases in the Eastern Division are to be assigned equally and randomly to Divisions 82 and 84. Eviction and Replevin actions in the Eastern Division are to be assigned as follows:
    • 50% – Division 80
    • 25% – Division 82
    • 25% – Division 84
  1. Except for Small Claims, County Civil cases in the Western Division are to be assigned equally and randomly to Divisions 71 and 73. Small Claims actions in the Western Division are to be assigned as follows:
    • 50% – Division 74
    • 25% – Division 71
    • 25% – Division 73
  1. County Civil cases in which a geographical division (Eastern, Western) cannot be determined are to be assigned randomly to Divisions 71, 73, 82 and 84.
  2. East-side Civil Infractions are to be assigned equally and randomly to Divisions 82 and 84. West-side Civil Infractions are to be assigned equally and randomly to Divisions 71 and 73. Civil Infractions from the southeastern part of the county are to be assigned equally and randomly to Divisions 71 and 73.
  3. East-side criminal cases, including those from the southeastern part of the county, are to be assigned equally and randomly to Divisions 81, 83 and 85. Cases previously disposed of in Division 80 are to be reassigned equally and randomly to Divisions 81, 83 and 85 if reopened. West-side criminal cases are to be assigned equally and randomly to Divisions 70 and 72.
  4. The Clerk of Court’s office is to assign cases as specified in this Order.  If any uncertainty or ambiguity arises concerning the assignment of a case, the matter should be referred to the Court Administrator’s office for resolution by the Chief Judge (see Kruckenberg v. Powell, 422 So. 2d 994).

 

            IT IS FURTHER ORDERED that administrative order G-2026-026-VL is hereby rescinded.
