Re: Schedule Conflicts

Ref: G-2022-039-SC

            WHEREAS, Rule 2.550, Florida Rules of General Practice and Judicial Administration addresses calendar conflicts, priority cases, and cases assigned expedited schedules;

            NOW THEREFORE, I, JAMES R. CLAYTON, Chief Judge of the Seventh Judicial Circuit of Florida, hereby orders the establishment of the following guidelines concerning calendar conflicts,

  1. Attorneys faced with conflicting court dates shall attempt to resolve the conflicts by making arrangements with the judges involved. Attorneys should attempt to resolve the conflict by rescheduling one or more of the conflicting proceedings; filing appropriate motions for continuances, or other appropriate relief; and/or arranging for associates, partners or other coverage counsel to handle one or more of the conflicting proceedings.
  1. If the conflict cannot be resolved, the affected attorney shall timely notify each judge involved, opposing counsel, and the Clerk of Court, in writing, of the conflict.  The notice shall clearly state the case names, case numbers, presiding judges, dates, and types of proceedings of each case involved in the conflict, and the attempts made to resolve the conflict. If the judges presiding over the conflicting cases do not resolve the conflict, the affected attorney shall attend the proceeding given a higher priority in accordance with Rule 2.550(a), Florida Rules of General Practice and Judicial Administration.
