Flagler, Putnam, St. Johns, and Volusia County courts will be closed Friday, April 3, in observance of Good Friday. Courts (courthouses) throughout the Seventh Circuit will resume normal operations on Monday, April 6.
WHEREAS, surety and/or cash bail bonds may be executed to secure the pretrial release of an arrestee pursuant to Rule 3.131(b)(1) & (h), Florida Rules of Criminal Procedure, and
WHEREAS, court rulings regarding the obligations of sureties / depositors when criminal charges are subsequently changed, recast, or supplemented have been issued which require further determinations be made, and
WHEREAS, the undersigned has been advised of the necessity to issue an Administrative Order on this subject for the prompt and efficient administration of justice in the Seventh Judicial Circuit;
NOW THEREFORE, I, TERENCE R. PERKINS, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order that the release of a bail bond to a depositor and/or the discharge of a surety shall occur only after all criminal charges related to the instant offense have been disposed of, when judgment on forfeiture is paid, upon the filing of a PTI / DPA by the State Attorney, upon further order of the court, or upon the surrender of the defendant to an appropriate law enforcement agency or correctional facility as permitted by law. Individuals seeking the release of a bail bond or the discharge of a surety absent the occurrence of the above-referenced actions shall file an appropriate motion with the court.
