        WHEREAS, it has been known to the undersigned that the prompt and efficient administration of justice in Volusia County requires general guidelines concerning the processing of Civil Traffic Infractions;

        NOW THEREFORE, I, LEAH R. CASE, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order that civil traffic infractions issued in Flagler, Putnam, St. Johns, or Volusia counties are to be processed in accordance with the following provisions:

1. Pursuant to § 318.14, Florida Statutes, anyone receiving a Civil Traffic Infraction must elect one of the following options within thirty (30) calendar days of the date the citation was issued:

                        Option 1:  Pay the civil penalty imposed

                        Option 2:  Elect to attend traffic school

                        Option 3:  Plead Nolo Contendre (No Contest)

                        Option 4:  Request a court hearing date.

2. Each Clerk of Court’s office is authorized to grant one-time continuances and to re-set matters on the next available traffic infraction date.

3. Clerks’ offices are authorized to grant one-time, sixty (60) day extensions to anyone who requests additional time to complete a class.

4. Clerks’ offices are authorized to grant one-time, sixty (60) day payment extensions at no charge to anyone who elects Option 1 above. Requests for payment extensions must be submitted to the Clerk’s office on a Payment Extension Agreement form within thirty (30) calendar days of the date the citation was issued.

5. Anyone may request to enter a payment plan with a Clerk’s office for an additional fee of $25. Requests for payment plans must be submitted to the Clerk’s office on a Payment Plan Agreement form within thirty (30) calendar days of the date the citation was issued.

6. Clerks’ offices are authorized to grant requests to remove matters from “collections,” assuming fines are paid in full, or payment plans have been established.

7. Clerks’ offices are authorized to release “D6s with costs” for failures to appear and/or failures to pay, assuming payment arrangements are made contemporaneously.

8. Anyone requesting a payment extension or a payment plan must be advised of the following:

• • Payment of fines are considered admissions of guilt.
  • Payment extension and payment plan requests are considered waivers of the right to speedy trial under Rule 6.325, Florida Traffic Court Rules.
  • Payment extension and payment plan requests are considered waivers of the rights to elect to attend traffic school and to request a court hearing date.

9. The Clerks’ offices are authorized to prepare Affidavits and place individuals under oath who elect Option 2 above.

10. Service of witness subpoenas on law enforcement officers may be made by email. Service by email satisfies the requirements of Section 48.031(3), Florida Statutes.    

        IT IS FURTHER ORDERED that Administrative Order T-2022-007-VL is hereby rescinded.
