IN THE CIRCUIT COURT OF FLORIDA, SEVENTH JUDICIAL CIRCUIT IN AND FOR FLAGLER, PUTNAM, ST. JOHNS AND VOLUSIA COUNTIES

Re: Blanket Notice to Participate in Discovery

Ref: CR-2017-021-SC

WHEREAS, the State Attorney and the Public Defender of the Seventh Judicial Circuit both recognize that the institution of a Blanket Demand for Discovery, pursuant to Florida Rule of Criminal Procedure 3.220 and Florida Rule of Juvenile Procedure 8.060 in all criminal and juvenile cases filed in the Circuit and County Courts of the Seventh Judicial Circuit, will allow for a more efficient handling of cases without prejudicing the defense or the State, and

WHEREAS, the Public Defender has made such a Blanket Demand, the original of which is attached hereto*, and

WHEREAS, the State Attorney has agreed to accept this Blanket Demand for Discovery which obligates the State Attorney to comply with the applicable provisions of Florida Rule of Criminal Procedure 3.220 within fifteen (15) days of the appointment of the Office of the Public Defender, and Florida Rule of Juvenile Procedure 8.060 within five (5) days of the appointment of the Office of the Public Defender, and

WHEREAS, the Public Defender has agreed to accept the Blanket Demand as a full and complete demand for reciprocal discovery pursuant to Florida Rule of Criminal Procedure 3.220 and Florida Rule of Juvenile Procedure 8.060.

NOW THEREFORE, I, TERENCE R. PERKINS, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order as follows:

  1. For purposes of discovery pursuant to Florida Rule of Criminal Procedure 3.220 and Florida Rule of Juvenile Procedure 8.060 the Blanket Demand for Discovery attached hereto* is deemed to be filed in each Circuit Court criminal and juvenile delinquency case and County Court criminal case filed in the Seventh Judicial Circuit at the time of the appointment of the Office of the Public Defender as defense counsel.
  2. Said demand is to be treated as a full and complete demand for all discovery permitted by the State or defense pursuant to the above-cited rules.
  3. This order remains in effect until further order of the Chief Judge.
