CV-2000-011-VL

IN THE CIRCUIT COURT OF FLORIDA, SEVENTH JUDICIAL CIRCUIT IN AND FOR VOLUSIA COUNTY

Re: EMINENT DOMAIN CASES

Ref: CV-2000-011-VL

WHEREAS, it has been made known to the undersigned that the efficient and proper administration of justice in Volusia County requires each parcel in eminent domain proceedings to be individually accounted for in the Circuit Court, therefore requiring files for each parcel,

NOW THEREFORE, I, ROBERT K. ROUSE, JR., Chief Judge of the Seventh Judicial Circuit of Florida, hereby order as follows:

  1. When a party files any pleading in an eminent domain case in Volusia County other than the initial Complaint, Lis Pendens, Order of Taking, Order Regulating Pleadings, Summonses or other paper common to all parcel(s), the pleading(s) or paper must contain the appropriate parcel number under the case number caption.
    a)      The Clerk of the Circuit Court in Volusia County will maintain a master docket for each case. Each parcel will have a separate court file and court docket sheet. All orders, pleadings, motions and other papers will, when filed and docketed, be placed in the appropriate parcel file.
    b)      All orders, pleadings, motions and other papers will bear the initial case style. Documents intended to apply only to particular parcel(s) will indicate in their caption the parcel number(s) to which they apply and sufficient copies shall be provided to the Clerk of Court to allow the filing and docketing of each relevant paper in each parcel file.
    c)      If a party fails to supply sufficient copies of a paper for each parcel, the Clerk of Court shall file the paper, but shall contact the party and request sufficient copies for filing in each parcel file.

TO BE RECORDED in Volusia County, Florida.

DONE AND ORDERED at Daytona Beach, Volusia County, Florida, this 3rd day of August, 2000.
