Flagler, Putnam, St. Johns, and Volusia County courts will be closed Monday, Feb. 16, for Presidents’ Day. Courts (courthouses) throughout the Seventh Circuit will resume normal operations on Tuesday, Feb. 17.
WHEREAS, it has been made known to the undersigned that the establishment of a fine amount for all non-criminal statutory violations, as that term is defined in § 775.08(3), Florida Statutes, wherein no fine amount is specified, is in the best interest of the circuit;
NOW THEREFORE, I, LEAH R. CASE, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order that the fine amount for non-criminal infractions committed in the counties of Flagler, Putnam, St. Johns, and Volusia, wherein no fine amount is specified, be set at $200.00. In instances where an alleged violator receives a Notice to Appear/Citation from a law enforcement officer and the payable amount listed on the Notice/Citation differs from the fine amount established herein, the lesser amount controls. Law enforcement agencies are to submit Notices/Citations to the Clerk of Court in the county in which the non-criminal infraction occurred within 24 hours of issuance. Alleged violators who wish to contest a citation and request a hearing before a County Court judge must do so within 30 days of the issue date of the Notice/Citation by contacting the Clerk of Court.
IT IS FURTHER ORDERED that alleged violators who wish to contest a citation, fail to pay the fine, or request a court date within 30 days of the issue date are to be set for arraignment before a County Court judge. Persons appearing before a County Court judge waive the limitations on the fine amount established by this Order. County Court judges may impose fines in amounts not to exceed $500 against persons they deem to have committed non-criminal infractions.
IT IS FURTHER ORDERED that the Clerk of Court is to enter pleas of nolo contendre (no contest) in cases in which the designated fine amount is paid prior to the start of trial or final disposition by the Court. In addition, the Clerk is directed to withhold adjudication of guilt, withdraw any capias issued, and close the cases.
IT IS FURTHER ORDERED that any prior administrative orders on this subject are hereby rescinded.
