IN THE CIRCUIT COURT OF FLORIDA, SEVENTH JUDICIAL CIRCUIT IN AND FOR FLAGLER, PUTNAM, ST. JOHNS AND VOLUSIA COUNTIES

Re: Court Facility Use Restrictions

Ref: G-2022-005-SC

        WHEREAS, the Florida Supreme Court has held that the court, through the chief judge’s exercise of administrative authority, has the inherent power to regulate use of spaces within court facilities, and

        WHEREAS, it has been determined that courts may restrict the use of court facilities for non-court purposes by drafting an appropriate policy addressing such issues,

        NOW THEREFORE, I, JAMES R. CLAYTON, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order the adoption of the following policy restricting the use of court facilities in Flagler, Putnam, St. Johns and Volusia counties:

The use of interior public spaces in court facilities in Flagler, Putnam, St. Johns and Volusia counties for non-court purposes is prohibited.  This prohibition includes, but is not limited to, the use of court facility space for commercial purposes, political purposes, and demonstrations, re-enactments, receptions and assemblies by organizations or groups not related to the Seventh Judicial Circuit Court or the operation thereof.  This prohibition also extends to non-binding arbitrations, private mediations, depositions in civil cases, and other similar activities.  This does not preclude the use of court facilities for matters related to public education about the court/legal system or mock trials sponsored by civic or educational groups.  Neither does this preclude counties from making arrangements for the operation of food service concessions in court facilities.  In addition, judges and other constitutional officers with offices in court facilities are not precluded from holding meetings in offices designated for their use, at their discretion.           

If an individual or organization wishes to utilize court facility space pursuant to the terms of the policy stated herein, a written request must by submitted to the Chief Judge or Court Administrator.  If the request is granted, the requestor must sign an agreement concerning the use of the facility (see Attachment A) and agree to pay any expenses related to the operation of the facility for the requested purpose.

Exceptions to this policy may be made at the discretion of the Chief Judge.
