Re: Cost of Supervision Fees for Felony Probation

Ref: CR-2025-028-SC (Rescinds CR-2017-028-SC)

          WHEREAS, pursuant to § 948.09, Florida Statutes, persons placed under supervision of the Florida Department of Corrections must, as a condition of supervision, pay the Department a total sum of money not to exceed the actual per diem cost of said supervision;

          NOW THEREFORE, I, LEAH R. CASE, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order that in the absence of any specific amount set by the sentencing judge, the cost of supervision for those placed under supervision of the Florida Department of Corrections on or after January 5, 2026, is set at $55.00 per month.  The sentencing judge may waive payment of the said cost of supervision fee if he/she is of the opinion that the defendant does not possess the ability to pay it.

          IT IS FURTHER ORDERED that if a defendant fails to pay court-ordered fees, fines, or costs, and the supervising officer believes he/she possesses the ability to pay, the supervising officer is to report the failure to pay in a timely fashion.  Regardless of a defendant’s ability to pay, if he/she fails to pay costs of supervision fees, or court-ordered costs other than restitution, the supervising officer is to report the failure to pay no later than 120 days prior to the expiration of the defendant’s term of supervision.  In either event, reports alleging a defendant’s failure to pay fees, fines, or costs must be substantiated by the supervising officer.

IT IS FURTHER ORDERED that regardless of a defendant’s ability to pay, if he/she fails to pay restitution, the supervising officer is to report the failure to pay in a timely fashion.
