IN THE CIRCUIT COURT OF FLORIDA, SEVENTH JUDICIAL CIRCUIT IN AND FOR FLAGLER, PUTNAM, ST. JOHNS AND VOLUSIA COUNTIES

Re: Preparation of TASC Substance Abuse Evaluations

Ref: CR-2022-004-V

        WHEREAS, the undersigned has been advised of the need to promulgate a standard procedure concerning the preparation and content of substance abuse evaluations conducted by TASC;

        NOW THEREFORE, I, JAMES R. CLAYTON, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order as follows:

  1. In cases in which TASC has been ordered to conduct a substance abuse evaluation, said evaluation must address defendant’s substance abuse history, current situation, and need for substance abuse treatment and/or counseling.
  1. In conducting said evaluation, TASC shall consider the following:

(a) The complaint affidavit charging the currently pending substantive crime against the defendant and/or any affidavit and report charging any pending violations of Community Control or Probation;

(b) Information provided by the defendant’s family members and acquaintances concerning the defendant’s recent drug or alcohol usage and/or symptoms consistent therewith; as well as information concerning any prior substance treatment or counseling, including whether it was inpatient or outpatient, voluntary or involuntary, successful or unsuccessful.  TASC is specifically authorized and directed to contact the individuals described herein; and

(c) Information from the Department of Corrections (Probation and Parole Services) concerning the defendant’s substance abuse treatment or counseling history.

  1. Upon completion of an evaluation, TASC shall provide a written report to the Court, with copies provided to the State Attorney, Defense Counsel, Probation, Pretrial Services, and Referred Treatment Providers, within fifteen (15) business days from the date of the order, absent an extension being requested and granted.
