IN THE CIRCUIT COURT OF FLORIDA, SEVENTH JUDICIAL CIRCUIT IN AND FOR VOLUSIA COUNTY

Re: Civil Traffic Infraction Processing

Ref: T-2022-007-V

     WHEREAS, it has been known to the undersigned that the prompt and efficient administration of justice in Volusia County requires general guidelines concerning the processing of Civil Traffic Infractions, and

     NOW THEREFORE, I, JAMES R. CLAYTON, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order that civil traffic infractions issued in Volusia County shall be processed in accordance with the following provisions:

1. Pursuant to Section 318.14, Florida Statutes, an individual charge with committing a Civil Traffic Infraction must elect one of the following options within thirty (30) calendar days of the date the citation was issued:

  • Option 1: Pay the civil penalty imposed
  • Option 2: Elect to attend traffic school
  • Option 3: Plead Nolo Contendre (No Contest)
  • Option 4: Request a court hearing date.

 

2. The Clerk of Court’s office is authorized to grant a one-time, sixty (60) day payment extension at no charge to each individual who elects Option 1 above. A request for a payment extension must be submitted on a Payment Extension Agreement form.

3. Alternatively, an individual may request to enter into a payment plan with the Clerk of Court’s office for a one-time additional fee of $25. A request for a payment plan must be submitted on a Payment Plan Agreement form.

4. The Clerk of Court’s office shall advise all individuals requesting payment extensions or payment plans of the following:

  • Payment Extension Agreements or Payment Plan Agreements must be completed and submitted to the Clerk of Court’s office within thirty (30) calendar days of the date the citation was issued.
  • Payment of the fine is considered an admission of guilt.
  • Payment extension requests and payment plan requests are considered waivers of the right to speedy trial under Rule 6.325, Florida Traffic Court Rules.
  • Payment extension requests and payment plan requests are considered waivers of the rights to elect to attend traffic school and to request a court hearing date.

 
5. The Clerk of Court’s office is authorized to prepare Affidavits and place under oath individuals who elect Option 2 above.

6. Service of witness subpoenas on law enforcement officers within Volusia County may be made by email service at the designated distribution list provided by each law enforcement agency. Service by email shall satisfy the requirements of Section 48.031(3), Florida Statutes.
