Re: Division Assignment of Sexting Cases

Ref: FM-2015-048-SC (Rescinds P-2013-228)

WHEREAS, it has been made known to the undersigned that the prompt and expeditious administration of justice requires that direction be given to the clerks of court concerning the assignment of sexting cases (§ 847.0141, Florida Statutes);

NOW THEREFORE, I, TERENCE R. PERKINS, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order that first-time violations of § 847.0141(1), Florida Statutes (sexting cases), are designated as noncriminal violations and are to be heard by circuit judges assigned to hear juvenile delinquency matters (see § 985.0301(1)(b), Florida Statutes.)

IT IS FURTHER ORDERED that that alleged first-time violators may elect to perform 8 hours of community service, pay a $60 civil penalty, or participate in a cyber-safety program in lieu of appearing in court (see § 847.0141(3)(a), Florida Statutes).  Alleged violators who fail to submit proof of performance of community service hours, payment of the civil penalty, or participation in a cyber-safety program within 30 days of the date the citation was issued are to be scheduled for a court date before the assigned judge.

IT IS FURTHER ORDERED that administrative order P-2013-228 is rescinded.
