IN THE CIRCUIT COURT OF FLORIDA, SEVENTH JUDICIAL CIRCUIT IN AND FOR FLAGLER, PUTNAM, ST. JOHNS AND VOLUSIA COUNTIES

Re: SERVICE OF DOMESTIC, REPEAT, SEXUAL & DATING VIOLENCE INJUNCTIONS FOR PROTECTION BY MUNICIPAL LAW ENFORCEMENT AGENCIES

Ref: FM-2010-014-SC (Rescinds FM-2002-014-SC)

WHEREAS, §§ 741.30(8)(a)1 and 784.046(8)(a)1, Florida Statutes, provide that the chief judge of each judicial circuit, in consultation with appropriate sheriffs, may authorize law enforcement agencies within his/her judicial circuit to effect service of injunctions for protection against domestic violence, repeat violence, sexual violence and dating violence, and

WHEREAS, the undersigned chief judge has consulted with the Sheriffs’ offices in Flagler, Putnam, St. Johns and Volusia counties concerning this matter;

NOW THEREFORE, I, J. DAVID WALSH, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order that the Sheriffs’ departments of Flagler, Putnam, St. Johns and Volusia counties shall be the primary entities responsible for the service of domestic violence, repeat violence, sexual violence and dating violence injunctions for protection issued by the judges of the Seventh Judicial Circuit against respondents located in their respective jurisdictions.

IT IS FURTHER ORDERED that when presented with a serviceable copy of an injunction for protection against domestic violence, repeat violence, sexual violence or dating violence, law enforcement officers with municipal police departments within Flagler, Putnam, St. Johns and Volusia counties are authorized to effect service of process on respondents located in their respective jurisdictions. Law enforcement officers with municipal police departments serving injunctions pursuant to this Order shall use service and verification procedures consistent with those of the Sheriff’s office of the county in which they are located.

IT IS FURTHER ORDERED that Administrative Order FM-2002-014-SC is hereby rescinded.
