Re: Withdrawal of Trial Counsel in Dependency, Termination of Parental Rights and Children/Families in Need of Services Proceedings

Ref: FM-2007-042-SC

WHEREAS, § 39.815(1), Florida Statutes, directs District Courts of Appeal to give appeals from orders terminating parental rights priority in docketing and to render decisions on such appeals as expeditiously as possible, and

WHEREAS, Rule 9.146(g), Florida Rules of Appellate Procedure, directs courts to give priority to appeals in juvenile dependency, termination of parental rights and Children/Families in Need of Services proceedings, and

WHEREAS, the assistance of trial courts has been sought to aid in the expeditious resolution of appeals in juvenile dependency, termination of parental rights and Children/Families in Need of Services proceedings;

NOW THEREFORE, I, WILLIAM A. PARSONS, Chief Judge of the Seventh Judicial Circuit of Florida, hereby order that in juvenile dependency, termination of parental rights and Children/Families in Need of Services proceedings, in which appeals are contemplated and/or being pursued, trial counsel for parties may not be permitted to withdraw as counsel of record until the following activities have been completed:

·         A notice of appeal has been filed;
·         Directions to the clerk have been filed;
·         Designations to the court reporter have been filed for transcripts of those portions of the proceedings necessary to support the issues on appeal; and
·         A motion to have the requisite proceedings transcribed has been filed (see Rules 8.255(g) & 8.625(f), Florida Rules of Juvenile Procedure).
