WHEREAS, Rule 12.490(f) Florida Family Law Rules of Procedure, provides, in part: The magistrate shall file the report and serve copies on the parties. The parties may serve exceptions to the report within ten (10) days from the time it is served on them. If no exceptions are filed within that period, the court shall take appropriate action on the report. If exceptions are filed, they shall be heard on reasonable notice by either party, or the court.
NOW THEREFORE, I, JULIANNE PIGGOTTE, Chief Judge of the Seventh Judicial Circuit of Florida, hereby direct the General Magistrates to file their reports with the Clerks of the Circuit Court upon completion and serve copies on the parties. Copies of said reports are to be maintained in the General Magistrates’ Offices in a tickler calendar system.
Any party filing an exception to this report shall copy the General Magistrate. The report and exceptions shall immediately be forwarded to the judge in whose division the case is assigned for hearing.
If no exceptions are served within ten (10) days, the report is to be forwarded to the judge in whose division the case is assigned, to take appropriate action on the report.
IT IS FURTHER ORDERED that Administrative Order # FM-2002-022 SC is hereby rescinded.
